Truck Accident Leaves Passenger In Critical Condition

A Santa Rosa truck accident resulted in critical injuries for an ejected passenger, and resulted in her being airlifted to the hospital. As KTVU.com reports:

Robert Walburn was driving a 2003 Ford pickup truck south on Highway 101 when he drove off the road onto the shoulder, California Highway Patrol officials said.

The truck overturned multiple times, ejecting passenger Heather Walburn from the car, before coming to a rest in the southbound lane where it caught on fire. The driver and another passenger, an infant girl, escaped the car before it became fully engulfed in flames. The infant and driver were treated at the collision for minor injuries, but the ejected passenger was air lifted to Santa Rosa Memorial hospital with major injuries.

Whether the truck driver was negligent will need to be determined. However, it sounds (and this is just a guess based upon my experience in personal injury cases) that the airlifted passenger was not wearing her seatbelt). Accordingly, she may be partially responsible for her serious injuries.
