Clancy & Diaz Settles Premises Liability Case for $1,300,000

We are thrilled to announce that we have settled a premises liability case (dangerous stairway) for $1,300,000. In doing so, we are able to bring some semblance of normalcy to our client.

Our client tripped and fell while going down a flight of unstable, uneven and dangerous steps She landed on the sidewalk below and badly fractured her ankle. The ankle was repaired with internal hardware, which prevented the wound from healing. Eventually it became badly infected. Our client underwent multiple rounds of debridement, where the non-healing skin was cut back. Our client then underwent a below-the-knee amputation ("BKA"). When that did not heal, our client required an above-the-knee amputation ("AKA").

We argued that the stairs were dangerous as a matter of law, and that, therefore, the landowner was negligent per se (meaning there is a presumption that the defendant is liable).
